Restricted. Governed by an EMERGENCY regulation after the Supreme Court voided the 2019 and 2020 versions - and the current text defines family by blood and marriage.

Occupancy cap

No headcount cap, but a stricter test: RC-2023 defines FAMILIA as the owner's spouse plus relatives within the 4th degree of consanguinity or 2nd degree of affinity. Unrelated roomers are not a family.

Is it a permitted use

No clean route. In the R-B, R-I, R-U, RT-I and RT-A districts a single dwelling's rooms must be 'funcionalmente relacionadas entre si para uso exclusivo de una familia' (Sec. 8.1.2.8), and districts are written around 'vivienda de una o dos familias'.

Registration or licensing

CASA DE HUESPED starts at SIX rooms (was seven in the 2015 text) up to 25, and needs Compania de Turismo approval plus 24-hour staffing and a dining room. Below six rooms there is no guest-house category to fall into - and no by-the-room category either.

State pre-emption

Territory-wide. Zoning is set by the Junta de Planificacion for the whole island, not by the municipality - so San Juan cannot loosen this locally. WARNING: the governing text is Reglamento Conjunto de Emergencia (Reg. 9473, 16 Jun 2023), adopted after the PR Supreme Court annulled the 2019 and 2020 Reglamentos in March 2023. The rules here have been struck down twice in five years.
