Occupancy cap
FIVE under city zoning, FOUR under state law. Boston Zoning Code Art. 2A: "Lodging House, any dwelling... in which living space, with or without common kitchen facilities, is let to five or more persons, who do not have equal rights to the entire dwelling and who are not living as a single, non-profit housekeeping unit." Massachusetts G.L. c.140 sec. 22 sets the state trigger lower, at four persons not within the second degree of kindred.
Is it a permitted use
THE ONE MARKET WHERE THE LEASE DECIDES THE ANSWER. The lodging-house trigger requires that occupants "do not have equal rights to the entire dwelling." A single joint lease giving every tenant equal rights to the whole house is not a lodging house. Separate per-room leases at five or more people is one. Note also that Boston's "family" definition expressly excludes any group of five or more full-time undergraduates.
Registration or licensing
Lodging House licence from the Boston Licensing Board plus Inspectional Services approval; lodging house is a forbidden or conditional use across most residential subdistricts. Every Boston rental also needs rental registration and a periodic inspection.
State pre-emption
Massachusetts G.L. c.140 sec. 22-23 governs lodging houses statewide and bites HARDER than Boston's own zoning - four persons, not five.
