Occupancy cap
TWO ROOMING UNITS is the practical line. Baltimore Building Code sec. 202.2.14: a "rooming house" is a building that "is not a multiple-family dwelling" and "contains more than 2 rooming units occupied or designed or intended to be occupied by individuals who, even though they might share common areas and facilities, do not form a single housekeeping unit and do not provide compensation under a single lease for occupancy of the rooming house." Separately, sec. 202.2.6 makes "any combination of 3 or more rooming units" a multiple-family dwelling. The zoning code's "family" is reported as up to four unrelated people forming a single housekeeping unit, plus up to two roomers - that part is SECONDARY-SOURCED and should be confirmed against Article 32 before you rely on it.
Is it a permitted use

A rooming house requires BOTH that the occupants do not form a single housekeeping unit AND that they do not pay "under a single lease." One joint lease over the whole house, with tenants who genuinely share the household, is not a rooming house on that text. Three or more separate per-room leases is one - and at three rooming units it is also a multiple-family dwelling, which a single-family certificate of occupancy will not carry.
Registration or licensing
A rooming house or multiple-family dwelling needs a use registration and a certificate of occupancy matching that class. Baltimore also runs a city-wide rental licensing and inspection programme covering essentially all non-owner-occupied residential rentals.
State pre-emption
Maryland does not broadly preempt local rental regulation; Baltimore is a home-rule city and regulates occupancy and licensing itself.
