Can you rent by the room in Staten Island, NY?

Depends on the detail. Legal by the room ONLY inside a household - a resident household plus up to four paying roomers. Let the rooms independently and it becomes a multiple dwelling. (Staten Island is New York City - same statute.)

Occupancy cap

FOUR ROOMERS, PLUS THE HOUSEHOLD. NY Multiple Dwelling Law sec. 4(5): a "family" is "either a person occupying a dwelling and maintaining a household, with not more than four boarders, roomers or lodgers, or two or more persons occupying a dwelling, living together and maintaining a common household, with not more than four boarders, roomers or lodgers." The same section defines a boarder/roomer/lodger as "a person living within the household who pays a consideration for such residence." One household plus four paying roomers is still ONE family.

Is it a permitted use

THE STRUCTURE DECIDES IT HERE, MORE SHARPLY THAN ANYWHERE ELSE. The four-roomer allowance only works if there is a genuine resident household - the roomers live WITHIN it. Remove the household and let rooms to people living independently of each other, and at three or more you have a "multiple dwelling" under sec. 4(7) ("three or more families living independently of each other") and a "rooming house" under sec. 4(13), which that section itself defines as a multiple dwelling. In a one- or two-family house carrying a private-dwelling certificate of occupancy that is an ILLEGAL CONVERSION, and NYC DOB enforces it hard. Do not confuse any of this with Real Property Law sec. 235-f, the Roommate Law - that is a TENANT's right to bring in one roommate, not an owner's permission to run a rooming house.

Registration or licensing

The Certificate of Occupancy must match the class of dwelling; a private-dwelling C of O will not carry a rooming-house use. Multiple dwellings must be registered with HPD. NYC Local Law 18 short-term-rental registration does NOT reach stays of 30 days or more, which is where this model sits.

State pre-emption

New York State Multiple Dwelling Law governs, and applies to cities of 325,000 or more (MDL sec. 3(1)) - in practice New York City only. Other New York cities may adopt it by local law. Buffalo, Rochester, Albany and Syracuse are all below that threshold and are NOT covered by this entry.
