Occupancy cap

FOUR. Dallas Development Code: "family" means individuals living together as a single housekeeping unit in which not more than four individuals are unrelated to the head of the household.

Is it a permitted use

The four-unrelated cap in the Dallas code is no longer enforceable: SB 1567 (2025) bars Texas municipalities from limiting occupancy on the basis of relationship. Renting by the room is not capped on headcount of unrelated occupants. Workable in a 4-bedroom, not in a 6. Above four unrelated occupants you are outside the family definition and into a lodging or boarding use that is not permitted by right in single-family districts.

Registration or licensing

No general rooming-house licence. Dallas does operate a residential rental registration and inspection programme - registration is required for most rental properties.

State pre-emption

STATE PREEMPTION. SB 1567 (2025) overrides the municipal cap. Texas broadly preempts local rental regulation and bars rent control.
